Terms and Conditions

These terms and conditions of use (referred to as 'Terms') govern the legal framework for providing the Betpuck application and define the conditions of access and use of the services by 'the User'.

These Terms are accessible on the application under the 'Terms' section.

Any registration or use of the Betpuck application implies unconditional acceptance of these Terms by the user. When registering on the application, each user expressly accepts these Terms by checking the box preceding the following text: 'I have read and accept the terms and conditions of use'. In case of non-acceptance of the Terms stipulated in this contract, the User must refrain from accessing the services offered by the application.

Betpuck reserves the right to unilaterally modify these Terms at any time.

The Betpuck application is published by the Individual Enterprise (EI) PORT Clément, under the commercial name of P&GT Technologies, registered with the National Register of Enterprises (RNE) under number 940 694 441.

ARTICLE 2: Application Content

2.1 Nature of the service

The application provides a platform for organizing one or more prediction contests between friends, family, colleagues, or others on ice hockey competitions. Users can join private competitions, organized by an Administrator in which they play within a private network. After registration, the User can either create a competition (2.1.1) or join a competition (2.1.2). The application also contains updated information on the results and rankings of the presented competitions. The results and other statistical information displayed on the site are based on information provided by other independent sources (third parties), internal work, or other official applications. The User is solely responsible for the use of the results and other information displayed on the site and the trust the User places in this information.

2.1.1 Creating a competition

By creating a competition, the User obtains Administrator status, and then has the choice between:

Once the competition is created, the Administrator has a Token (sequence of characters assigned to a competition to allow Users to join it) which they will use to invite participants to the contest.

Once the invitation is accepted and their account created, new Users can start playing.

2.1.2 Joining a competition

The User has the possibility to directly join a private competition organized by an Administrator, via an invitation Token

2.2 Access to the application

The Betpuck application is freely accessible anywhere to any User with Internet access. All costs incurred by the User to access the service (computer hardware, software, Internet connection, etc.) are at their expense.

The Betpuck application is in principle accessible to Users at any time, but for proper management, the individual enterprise (EI) Clément PORT reserves the right to:

To access the services, Users must register by linking their account with either their Google or GitHub credentials through a secure OAuth 2.0 authentication process. Users can then log in using their verified email address associated with these accounts.

The provided email address is verified by Google or GitHub during the authentication process to ensure the identity of the User. Only Users with verified accounts can access the services; non-registered Users are not permitted to use the application.

2.3 Unsubscribing

Any registered User member may also request to unsubscribe by contacting support via email at the following email address: betpuckcontact@gmail.com. This will be effective within a reasonable time.

2.4 Advertisements

The User accepts that advertisements, including third-party advertisements, may be displayed on the App.

ARTICLE 3: Privacy Policy

The application ensures the User a collection and processing of personal information in respect of privacy in accordance with Law No. 2018-493 of June 20, 2018, relating to the protection of personal data. This bill adapts to European Union law the Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms. It transposes the new European legal framework (Regulation 2016/679 and Directive 2016/680) which came into force in May 2018.

3.4 Security and confidentiality of data

The user's personal data is stored on online servers or with service providers offering this type of service. In accordance with Law No. 2018-493 of June 20, 2018, relating to the protection of personal data, EI PORT Clément or its service providers take all reasonable measures to ensure the security and confidentiality of personal data collected and processed by the Betpuck application. EI PORT Clément or its service providers commit to protecting this data against any loss, unauthorized access, disclosure, alteration, or destruction, through the use of technologies and security procedures adapted to protect personal data against potential threats.

3.5 Data retention

The user's personal data is retained for a minimum period of 5 years to fulfill the purpose of the processing. They will also be archived for a period of 10 years.

3.6 User rights

The user has rights concerning their personal data: access to data concerning them, rectify it, request its deletion or exercise their right to limit the processing of their data, withdraw their consent to the processing of their data at any time, exercise their right to data portability. ARTICLE 4: Intellectual Property

The brands, logos, signs as well as all the contents of the application (texts, images) are protected by the Intellectual Property Code and more particularly by copyright.

The Betpuck brand is a trademark registered by EI PORT Clément. Any representation and/or reproduction and/or partial or total exploitation of this brand, of whatever nature, is totally prohibited.

The User must request prior authorization from the application for any reproduction, publication, copy of the various contents. They commit to using the contents of the application in a strictly private setting, any use for commercial and advertising purposes is strictly prohibited.

Any total or partial representation of the application by any process whatsoever, without the express authorization of the operator of the application would constitute an infringement punishable by article L 335-2 and following of the Intellectual Property Code.

It is recalled in accordance with article L122-5 of the Intellectual Property Code that the User who reproduces, copies or publishes the protected content must cite the author and their source.

ARTICLE 5: Responsibility

The sources of information disseminated on the Betpuck application are deemed reliable but the application does not guarantee that it is free from defects, errors or omissions.

The information communicated is presented for indicative and general purposes without contractual value. Despite regular updates, the Betpuck application cannot be held responsible for changes to administrative and legal provisions occurring after publication. Similarly, the Betpuck application cannot be held responsible for the use and interpretation of the information contained in this site.

The User ensures to keep their password secret. Any disclosure of the password, in whatever form, is prohibited. They assume the risks related to the use of their identifier and password. The Betpuck application declines all responsibility.

The Betpuck application cannot be held responsible for any viruses that could infect the computer or any computer equipment of the Internet user, following a use, access, or download from the Betpuck application.

The responsibility of the application cannot be engaged in case of force majeure or the unpredictable and insurmountable fact of a third party.

Finally, the Betpuck application declines all responsibility in case of disputes between players.

ARTICLE 6: Hypertext links

Hypertext links may be present on the application set up with the authorization of EI PORT Clément. The User is informed that by clicking on these links, they will leave the Betpuck application.

EI PORT Clément does not have the possibility to verify the content of the sites thus visited, and will consequently assume no responsibility for this fact.

The establishment of all hypertext links to all or part of the site is strictly prohibited, except with the prior written authorization of EI PORT Clément. EI PORT Clément is free to refuse this authorization without having to justify its decision in any way.

In the event that EI PORT Clément grants its authorization, it would in all cases only be temporary and could be withdrawn at any time, without obligation of justification.

ARTICLE 7: Interferences

The user must not use any mechanism, tool, software or procedure that has or could have a negative effect on the operation of our facilities, the security of the Internet or other Internet users. You must not overload our servers to which the application is hosted with automated requests, nor assist a third party in this activity. You are not authorized to modify, disassemble, decompile or reverse engineer the application in any way. In addition, you are not authorized to use the content of the application by integrating it, aggregating it, cutting it or recreating it without the express consent of EI PORT Clément.

ARTICLE 8: Cookies

The User is informed that during their visits to the application, a cookie may automatically install on their browsing software.

Cookies are small files temporarily stored on the hard drive of the User's computer by your browser and which are necessary for the use of the Betpuck application. Cookies do not contain personal information and cannot be used to identify someone. A cookie contains a unique identifier, randomly generated and therefore anonymous. Some cookies expire at the end of the User's visit, others remain.

By browsing the application, the user accepts them. The user can deactivate these cookies through the configuration settings of their equipment.

ARTICLE 9: Applicable law and competent jurisdiction

French legislation applies to this contract. In the absence of amicable resolution of a dispute arising between the parties, the French courts will have sole jurisdiction to hear it.
